Negligence is a legal term meaning carelessness.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-speeding-laws-in-texas\">Speeding Laws in Texas<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-texas-transportation-code-section-545-352-prima-facie-speed-limit\">Texas Transportation Code, Section 545.352 (\u201cPrima Facie Speed Limit\u201d)<\/h3>\n\n\n\n<p><a target=\"_blank\" href=\"https:\/\/statutes.capitol.texas.gov\/StatutesByDate.aspx?code=TN&amp;level=SE&amp;value=545.352&amp;date=6\/28\/2014\" rel=\"noreferrer noopener\">Section 545.352 of the Texas Transportation Code<\/a>&nbsp;lays out speed limits for the state. These speed limits depend on:<\/p>\n\n\n\n<ul class=\"check-list wp-block-list\">\n<li>The location (e.g., urban vs. rural areas)<\/li>\n\n\n\n<li>The type of vehicle (e.g. 18-wheeler, commercial bus)<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-texas-transportation-code-section-545-351-maximum-speed-limit\">Texas Transportation Code, Section 545.351 (\u201cMaximum Speed Limit\u201d)<\/h3>\n\n\n\n<p><a href=\"https:\/\/statutes.capitol.texas.gov\/StatutesByDate.aspx?code=TN&amp;level=SE&amp;value=545.351&amp;date=6\/28\/2014\" target=\"_blank\" rel=\"noreferrer noopener\">Section 545.351 of the Texas Transportation Code<\/a>&nbsp;states that deciding the safe maximum speed limit depends on the actual \u201cconditions\u201d on that road. In certain cases, driving safely may require that the driver slow down:<\/p>\n\n\n\n<ul class=\"check-list wp-block-list\">\n<li>At an intersection or railroad crossing<\/li>\n\n\n\n<li>Approaching and going around a curve<\/li>\n\n\n\n<li>Driving over a hill crest<\/li>\n\n\n\n<li>On a narrow or winding roadway<\/li>\n\n\n\n<li>A special hazard to traffic (e.g., pedestrians, bad weather or road conditions)<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-texas-car-accidents-and-texas-negligence-law\">Texas Car Accidents and Texas Negligence Law<\/h2>\n\n\n\n<p>Under Texas negligence law, someone whose carelessness harms another person may have to pay for the other person\u2019s injury. In the case of car accidents in Texas, deciding if there was negligence involves two main questions:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-was-the-driver-being-careful-enough-standard-of-care\">Was the driver being careful enough? (Standard of Care)<\/h3>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-vertically-aligned-center is-layout-flow wp-block-column-is-layout-flow\">\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"660\" height=\"330\" src=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/4a-1.jpg\" alt=\"\" class=\"wp-image-985\" srcset=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/4a-1.jpg 660w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/4a-1-540x270.jpg 540w\" sizes=\"(max-width: 660px) 100vw, 660px\" \/><\/figure>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-vertically-aligned-center is-layout-flow wp-block-column-is-layout-flow\">\n<h4 class=\"wp-block-heading\">Standard of Care<\/h4>\n\n\n\n<p>You are negligent if your behavior is less careful than a level set by the Court. This measurement is known as the standard of care. Courts require us to act in the way a \u201creasonable person\u201d would act under similar circumstances. If we do not, we do not meet the standard of care.<\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-vertically-aligned-center is-layout-flow wp-block-column-is-layout-flow\">\n<h4 class=\"wp-block-heading\">Negligence Per Se<\/h4>\n\n\n\n<p>When behavior violates a safety law, Texas Courts will generally assume that the behavior did not meet the standard of care. Unless you have a particularly good excuse for why you broke the safety law, judges and juries will usually decide you were legally too careless. This is known as<em>&nbsp;negligence per se<\/em>.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-vertically-aligned-center is-layout-flow wp-block-column-is-layout-flow\">\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"660\" height=\"330\" src=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/4b-1.jpg\" alt=\"\" class=\"wp-image-986\" srcset=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/4b-1.jpg 660w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/4b-1-540x270.jpg 540w\" sizes=\"(max-width: 660px) 100vw, 660px\" \/><\/figure>\n<\/div>\n<\/div>\n\n\n\n<p>If you were driving faster than the speed limit in a certain area, you were violating Texas safety laws.&nbsp;<a href=\"https:\/\/statutes.capitol.texas.gov\/StatutesByDate.aspx?code=TN&amp;level=SE&amp;value=545.352&amp;date=6\/28\/2014\" target=\"_blank\" rel=\"noreferrer noopener\">Section 545.352 of the Texas Transportation Code<\/a>&nbsp;also states that driving faster than the posted speed limit is evidence that the driving was unreasonable and careless.<\/p>\n\n\n\n<p>So if you were speeding, a Court will probably assume you were being careless. The next question is whether that negligent driving caused the accident.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Did the careless driving lead to the accident? (Causation)<\/h3>\n\n\n\n<p>In order to recover money for an injury under negligence law, the careless behavior must have caused the injury. Even if you behave carelessly, that behavior must cause the accident which led to the injury.<\/p>\n\n\n\n<p>For example, if you were driving 5 miles above the speed limit, but the other driver flew through a red light and plowed into you in the intersection, your careless driving (speeding) might not be considered the cause of the accident.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Texas Traffic Law and Comparative Fault (Proportionate Responsibility)<\/h2>\n\n\n\n<p>Under the road regulations and negligence laws of Texas, if more than one driver is caused an accident because of careless driving, a special rule applies. This is often called comparative fault, and in Texas is known as proportionate responsibility.<\/p>\n\n\n\n<p>In Texas, only drivers who were less than 51% at fault in causing the accident can receive money. (In legal speak, this is known as modified comparative negligence).<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1320\" height=\"450\" src=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/4c-1.jpg\" alt=\"\" class=\"wp-image-987\" srcset=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/4c-1.jpg 1320w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/4c-1-540x184.jpg 540w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/4c-1-768x262.jpg 768w\" sizes=\"(max-width: 1320px) 100vw, 1320px\" \/><\/figure>\n\n\n\n<p><strong>The bottom line:<\/strong>&nbsp;even if you were speeding, if the other driver was driving carelessly or in a reckless manner, you might both be at fault.
