It is a part of the <a href=\"https:\/\/www.justinian.com\/faqs\/#what-is-a-tort\">civil tort<\/a> of <em>negligence<\/em>. Negligence is the legal term for carelessness.<\/p>\n\n\n\n<p>Texas law requires that people and companies show a certain amount of care to not harm others. Different circumstances require different levels of care. For example, certain professionals like doctors have a higher duty of care to their patients that strangers have to one another.<\/p>\n\n\n\n<p>Landowners in Texas owe certain <em>duties of care<\/em> to people who live on their land.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-when-can-landowners-be-sued-by-injured-tenants-or-residents-of-their-land\">When Can Landowners Be Sued By Injured Tenants Or Residents Of Their Land?<\/h2>\n\n\n\n<p>In general, landowners cannot be sued if the tenant or other resident was injured by a dangerous condition that was already on the land when the tenant or resident moved in.<\/p>\n\n\n\n<p>But there are some very important exceptions:<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<h3 class=\"wp-block-heading\" id=\"h-when-a-landowner-knows-or-should-know-about-a-dangerous-condition-that-poses-unreasonable-risk-to-tenants\">When A Landowner Knows Or Should Know About A Dangerous Condition That Poses Unreasonable Risk To Tenants<\/h3>\n\n\n\n<p>There are certain risks that can harm the tenant, even though the tenant might not know about it. For example, if the walls are painted, the tenant might have no idea an apartment had a mold infestation, which could affect the tenant\u2019s health.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"640\" height=\"355\" src=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/11\/When-A-Landowner-Knows-Or-Should.jpg\" alt=\"\" class=\"wp-image-1834\" srcset=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/11\/When-A-Landowner-Knows-Or-Should.jpg 640w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/11\/When-A-Landowner-Knows-Or-Should-540x300.jpg 540w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/figure>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"640\" height=\"421\" src=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/11\/When-A-Landowner-Tells-The-Tenant.jpg\" alt=\"\" class=\"wp-image-1835\" srcset=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/11\/When-A-Landowner-Tells-The-Tenant.jpg 640w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/11\/When-A-Landowner-Tells-The-Tenant-540x355.jpg 540w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/figure>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<h3 class=\"wp-block-heading\" id=\"h-when-a-landowner-tells-the-tenant-something-will-be-repaired-in-the-apartment-but-fails-to-make-the-repair\">When A Landowner Tells The Tenant Something Will Be Repaired In The Apartment But Fails To Make The Repair<\/h3>\n\n\n\n<p>Sometimes an owner tells a prospective or current tenant (usually in the lease) that an unsafe condition (like a wobbly step) needs to be repaired, and that the owner will make the repairs.<\/p>\n\n\n\n<p>By making such a commitment, the owner has a duty to complete the repair and do it with care and attention.<\/p>\n\n\n\n<p>If the owner promises but fails to repair the unsafe condition, then the owner may be legally responsible for injuries caused by the unsafe condition.<\/p>\n<\/div>\n<\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-when-a-landowner-repairs-an-unsafe-condition-in-a-careless-negligent-manner\">When a landowner repairs an unsafe condition in a careless (negligent) manner<\/h3>\n\n\n\n<p>If the owner says an unsafe condition will be repaired, but the repair work is negligent, the owner may have to pay for injuries resulting from the condition. A repair might be negligent if the owner:<\/p>\n\n\n\n<ul class=\"check-list wp-block-list\">\n<li>Used substandard materials<\/li>\n\n\n\n<li>Did not follow city permit rules and safety requirements<\/li>\n\n\n\n<li>Did not have the knowledge of how to repair it properly<\/li>\n\n\n\n<li>Repaired the condition incompletely<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-when-a-landowner-keeps-part-of-the-leased-premises-under-their-control-but-lets-the-tenant-use-that-space\">When a landowner keeps part of the leased premises under their control, but lets the tenant use that space<\/h3>\n\n\n\n<p>Sometimes a landowner rents part of the land, and another portion is available for everyone who lives there. This might include:<\/p>\n\n\n\n<ul class=\"check-list wp-block-list\">\n<li>Stairway<\/li>\n\n\n\n<li>Elevator<\/li>\n\n\n\n<li>Apartment Entryway \/ Mailbox Room<\/li>\n\n\n\n<li>Club house \/ Community Pool \/ Common space<\/li>\n<\/ul>\n\n\n\n<p>When a landowner controls this public space but permits tenants and visitors to use it, the landowner must maintain the public area in a safe manner. If there is an unsafe condition, the landowner may be responsible for injuries caused by that condition.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-the-right-to-enter-only-for-repairs-usually-does-not-mean-the-landowner-is-in-control-of-the-property\">The right to enter <em>only for repairs<\/em> usually <em>does<\/em> <em>not mean<\/em> the landowner is in control of the property<\/h4>\n\n\n\n<p>Under Texas law, tenants have the exclusive right to use the land (or area \/ apartments) they are renting. The landowner cannot enter the tenant\u2019s exclusive space without permission.<\/p>\n\n\n\n<p>However, most landowners reserve the right to enter to make repairs. For example, if an apartment tenant\u2019s dishwasher is leaking, the landowner can enter the apartment to repair the dishwasher.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"640\" height=\"331\" src=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/11\/Shell-Oil-Co.jpg\" alt=\"\" class=\"wp-image-1837\" srcset=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/11\/Shell-Oil-Co.jpg 640w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/11\/Shell-Oil-Co-540x279.jpg 540w\" sizes=\"(max-width: 640px) 100vw, 640px\" \/><\/figure>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<h5 class=\"wp-block-heading\" id=\"h-shell-oil-co-v-khan-texas-law-and-landowner-liability\">Shell Oil Co. v. Khan &#8211; Texas Law and Landowner Liability<\/h5>\n\n\n\n<p>In the case of <a href=\"https:\/\/scholar.google.com\/scholar_case?case=11509986286455934480&amp;q=Shell+Oil+Co.+v.+Khan&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">Shell Oil Co. v. Khan<\/a>, the Texas Supreme Court decided that an owner who only has the right to enter to make repairs has not kept enough control over the property to be responsible for that space.<\/p>\n\n\n\n<p>If the owner does not have a duty of care to make an area safe, (like the tenant\u2019s apartment), then the landowner may not be legally responsible for injuries that occur from its unsafe condition.<\/p>\n<\/div>\n<\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-when-the-owner-leases-the-land-for-recreational-purposes-open-to-the-public\">When the owner leases the land for recreational purposes open to the public<\/h3>\n\n\n\n<p>Sometimes a landowner rents the land to someone who will offer admission to the public to engage in recreational activities on the land. For example, some landowners rent their space out as a campground for campers.<\/p>\n\n\n\n<p>If there is an unsafe condition that presents an <em>unreasonable risk of harm <\/em>to people entering the land, the owner must repair or remove that safe condition.<\/p>\n\n\n\n<ul class=\"check-list wp-block-list\">\n<li>This can include an unsafe condition <em>that the landlord should know about <\/em>(the landlord must inspect the property for safety issues)<\/li>\n\n\n\n<li>Landowner must know that the public will be allowed to enter before the condition is repaired<\/li>\n\n\n\n<li>The landowner can also take steps to make the public safe:\n<ul class=\"wp-block-list\">\n<li>Warning Sign<\/li>\n\n\n\n<li>Barrier to prevent the public from accessing the unsafe condition<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-texas-law-limits-a-landowner-s-responsibility-for-recreational-land\">Texas Law Limits A Landowner\u2019s Responsibility For Recreational Land<\/h3>\n\n\n\n<p>In certain cases, <a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/CP\/htm\/CP.75.htm\" target=\"_blank\" rel=\"noreferrer noopener\">Texas Civil and Remedies Code, Chapter 75<\/a> limits when a landowner is responsible for injuries and damage that occurs on land used for recreation.<\/p>\n\n\n\n<p>This law applies only when:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The landowner is the defendant (person or company being sued)<\/li>\n\n\n\n<li>The injured person entered the land for a recreational purpose.\n<ul class=\"wp-block-list\">\n<li>The definition of recreational purpose under Texas law is broad. It includes most activities that involve enjoying the outdoors:\n<ul class=\"wp-block-list\">\n<li>Camping <\/li>\n\n\n\n<li>Biking<\/li>\n\n\n\n<li> Water skiing <\/li>\n\n\n\n<li>Hunting<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Note: Texas courts have held that \u201crecreational activity\u201d does not include outdoor weddings.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The injured person was either:\n<ul class=\"wp-block-list\">\n<li>Not charged any money for admission, or<\/li>\n\n\n\n<li>Charged only an amount that is less than 20 times the owner\u2019s property tax, or<\/li>\n\n\n\n<li>The owner, lessee or occupier is required by law to have insurance coverage with the following minimums: $500,000 per person, $1M for every instance of bodily injury or death and $100,000 for every injury or property destruction.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>In these cases, the owner, lesses or occupier only owes the same duty as is owed to a trespasser. This is a very low duty of care.<\/p>\n\n\n\n<p>Note, the required insurance is also a cap (limit) on how much compensation an injured person can get.
