They lack legal capacity.<\/strong><\/p>\n\n\n\n<p>However, minors who have been injured can assert their rights in a lawsuit to recover compensation. Some suffer from mental illness like dementia or brain defects. These folks are said to <em>not be of sound mind<\/em>, known by the legal term <em>non compos mentis<\/em>.<\/p>\n\n\n\n<p>People who cannot take care of themselves <em>lack legal capacity<\/em>. The legal term for this declaration is <em>emancipation<\/em>.<\/p>\n\n\n\n<p>In order to petition the court for emancipation, minors in Texas must be:<\/p>\n\n\n\n<ul class=\"check-list wp-block-list\">\n<li>Texas Residents<\/li>\n\n\n\n<li>At least 17-years old &#8211; or 16-years old if living away from their parent(s)<\/li>\n\n\n\n<li>Able to support and manage their own affairs<\/li>\n<\/ul>\n<\/div>\n<\/div>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-legal-guardians-for-minors-in-texas\">Legal Guardians for Minors in Texas<\/h4>\n\n\n\n<p>Most minors have a legal guardian of some kind. This may be a parent or family member.<\/p>\n\n\n\n<p>However, when there is no family member who will care for the minor, the court can appoint a guardian to look after the minor, and help make decisions on the minor\u2019s behalf.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-minors-and-next-friends-under-texas-law\">Minors and Next Friends Under Texas Law<\/h3>\n\n\n\n<p>As people who lack legal capacity, minors cannot file lawsuits by themselves. But minors who have been harmed need a way to recover compensation from the person or company that caused their injuries or property damage.<\/p>\n\n\n\n<p>Fortunately, the Texas legal system provides a way for minors to protect their rights by suing in court through a representative. This legal representative is known as a <em>next friend<\/em>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-texas-rule-44-permits-minors-to-file-lawsuits-with-a-next-friend\">Texas Rule 44 Permits Minors to File Lawsuits with a Next Friend<\/h4>\n\n\n\n<p><a href=\"https:\/\/www.txcourts.gov\/media\/1055394\/trcp-20150901.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Rule 44<\/a> of the Texas Rules of Civil Procedure allows minors and others who lack legal capacity to sue in court with a &#8220;next friend&#8221; representative.<\/p>\n\n\n\n<p><strong>Under Rule 44:<\/strong><\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h5 class=\"wp-block-heading\" id=\"h-the-next-friend-has-the-same-powers-as-a-legal-guardian\">The Next Friend has the same powers as a legal guardian<\/h5>\n\n\n\n<p>Anyone filing a lawsuit must make many decisions, including:<\/p>\n\n\n\n<ul class=\"check-list wp-block-list\">\n<li>When to sue<\/li>\n\n\n\n<li>Which Lawyer to Hire<\/li>\n\n\n\n<li>How Much to Sue For<\/li>\n\n\n\n<li>Whether or not to settle<\/li>\n<\/ul>\n\n\n\n<p>Rule 44 allows the Next Friend to make all these decisions for the minor, just like a legal guardian would decide things like where the minor will attend school.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h5 class=\"wp-block-heading\" id=\"h-the-next-friend-must-give-security-or-affirmations\">The Next Friend must give security or affirmations<\/h5>\n\n\n\n<p>Most lawsuits involve costs like court and attorney\u2019s fees, as well as expenses for investigations and expert testimony. Under Rule 44, the Next Friend must give proof or security that any expenses owed by the minor in the lawsuit will be paid by the next friend.<\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h5 class=\"wp-block-heading\" id=\"h-the-lawsuit-is-binding-on-the-minor\">The lawsuit is <em>binding<\/em> on the minor<\/h5>\n\n\n\n<p>If a lawsuit is binding, the person who filed the lawsuit cannot file another lawsuit later for the same accident or injury.<\/p>\n\n\n\n<p>The lawsuit is binding if the judge or jury gave a decision in the case or the parties signed an agreement to end the lawsuit.<\/p>\n\n\n\n<p>So if the next friend agrees to a settlement, the minor cannot file another lawsuit later for the same injuries.
