{"id":1413,"date":"2020-10-30T23:45:25","date_gmt":"2020-10-30T23:45:25","guid":{"rendered":"https:\/\/www.justinian.com\/?post_type=faqs&#038;p=1413"},"modified":"2024-01-03T17:30:28","modified_gmt":"2024-01-03T23:30:28","slug":"are-settlements-for-minors-different-from-adults","status":"publish","type":"faqs","link":"https:\/\/www.justinian.com\/es\/faqs\/son-los-acuerdos-para-menores-de-edad-diferentes-de-los-adultos\/","title":{"rendered":"Are Settlements for Minors Different From Adults?"},"content":{"rendered":"\n<p><strong>Minors in Texas lack legal capacity, so they cannot file a lawsuit by themselves in Texas.<\/strong><\/p>\n\n\n\n<p>But <a href=\"https:\/\/www.txcourts.gov\/media\/1055394\/trcp-20150901.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Rule 44<\/a> of the Texas Rules of Civil Procedure allows injured minors to file a lawsuit with a court-appointed legal representative known as a <em>next friend<\/em>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-settlements-by-a-next-friend-legal-representative-in-texas\">Settlements by a Next Friend Legal Representative in Texas<\/h2>\n\n\n\n<p>Minors can settle their lawsuits in mostly the same way as anyone who files a lawsuit.<\/p>\n\n\n\n<p>However there are some important provisions for settlements by next friends under Texas Civil Procedure Rule 44:<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h3 class=\"wp-block-heading\" id=\"h-the-next-friend-can-choose-to-settle-the-case\">The Next Friend can choose to settle the case<\/h3>\n\n\n\n<p>Rule 44 allows the Next Friend to make all these decisions for the minor, just like a legal guardian would decide things like where the minor will attend school.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h3 class=\"wp-block-heading\" id=\"h-the-next-friend-must-give-security-or-affirmations\">The Next Friend must give security or affirmations<\/h3>\n\n\n\n<p>Lawsuits generally involve costs like court and attorney\u2019s fees. Rule 44 requires that the Next Friend gives proof or security that any expenses owed by the minor in the lawsuit will be paid by the next friend.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h3 class=\"wp-block-heading\" id=\"h-the-lawsuit-settlement-is-binding-on-the-minor\">The lawsuit settlement is <em>binding<\/em> on the minor<\/h3>\n\n\n\n<p>If the next friend decides to settle the minor\u2019s lawsuit and signs a settlement, the legal settlement is <em>binding<\/em> on the minor.
