There are parts of the U.S. Constitution that protect you even if you don&#8217;t have the right immigration papers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-fourteenth-amendment-applies-to-most-undocumented-people-in-the-u-s\">The Fourteenth Amendment Applies to Most Undocumented People in the U.S.<\/h2>\n\n\n\n<p>The Fourteenth Amendment of the United States Constitution guarantees that the government can\u2019t take away a person\u2019s life, liberty or property without a fair trial. It also guarantees that the laws must protect everyone.<\/p>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p><em>No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.<\/em><\/p><\/blockquote><\/figure>\n\n\n\n<p>You are a &#8220;person&#8221; even if you&#8217;re undocumented. The person or company being sued for causing the harm is called the <em>defendant<\/em>. In Texas, several undocumented plaintiffs have filed personal injury lawsuits against the defendants that harmed them.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1390\" height=\"359\" src=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/faq-content-6-image-1.jpg\" alt=\"\" class=\"wp-image-1364\" srcset=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/faq-content-6-image-1.jpg 1390w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/faq-content-6-image-1-540x139.jpg 540w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/faq-content-6-image-1-768x198.jpg 768w\" sizes=\"(max-width: 1390px) 100vw, 1390px\" \/><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-federal-immigration-laws-do-not-prevent-undocumented-residents-from-filing-personal-injury-lawsuits\">Federal Immigration Laws Do Not Prevent Undocumented Residents From Filing Personal Injury Lawsuits<\/h3>\n\n\n\n<p>In the case of <a href=\"https:\/\/scholar.google.com\/scholar_case?case=7420322511786784197&amp;q=Grocers+Supply,+Inc.+v.+Cabello&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">Grocers Supply, Inc. v. Cabello<\/a>, three brothers living in the U.S. illegally were hurt when a delivery tractor trailer collided with their pickup trucks. Even though the the brothers were undocumented, they were able to file a personal injury lawsuit in Texas against the delivery driver\u2019s employer.<\/p>\n\n\n\n<p>The court ruled that the U.S. Immigration Reform and Control Act of 1986 (IRCA) was not created to get in the way of personal injury claims.<\/p>\n\n\n\n<p>Even though the plaintiffs were living in the U.S. illegally as undocumented workers, they were able to recover lost wages and medical expenses from the defendants that harmed them.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-vertically-aligned-center is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:70%\">\n<h3 class=\"wp-block-heading\" id=\"h-undocumented-people-can-sue-for-lost-wages-and-future-wages\">Undocumented People Can Sue for Lost Wages and Future Wages<\/h3>\n\n\n\n<p>If you are an undocumented person and file a personal injury case, you may be able to receive money for your medical costs, pain and suffering and money you\u2019ve lost from being out of work.<\/p>\n\n\n\n<p>Several Texas courts have also said that a plaintiff seeking money damages for lost wages or future earnings in a personal injury lawsuit does not need to provide citizenship or proper immigration papers.<\/p>\n\n\n\n<p>For example, <a href=\"https:\/\/scholar.google.com\/scholar_case?case=4613554540750001075&amp;q=Tyson+Foods,+Inc.+v.+Guzman&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">Tyson Foods, Inc. v. Guzman<\/a> is another example of an undocumented worker successfully filing a personal injury in Texas. In that case the court ruled a worker can receive <em>lost wages and future wages<\/em> even if they are undocumented.<\/p>\n\n\n\n<p>Similarly, the Fifth District Court of Appeals in Dallas said the IRCA doesn&#8217;t prevent undocumented workers from receiving damages if they file a personal injury lawsuit.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-vertically-aligned-center is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:30%\">\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"430\" height=\"364\" src=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/faq-content-6-image-2.jpg\" alt=\"\" class=\"wp-image-1366\"\/><\/figure>\n<\/div>\n<\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-undocumented-people-can-file-a-lawsuit-for-premises-liability-injuries\">Undocumented People Can File a Lawsuit for Premises Liability Injuries<\/h3>\n\n\n\n<p>In the case of <a href=\"https:\/\/scholar.google.com\/scholar_case?case=5720930630340333934&amp;q=Wal-Mart+Stores+Inc.+v.+Cordova&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">Wal-Mart Stores Inc. v. Cordova<\/a>, an undocumented resident was injured while shopping in a store. Despite her undocumented status, Ms. Cordova was permitted to receive money for her injuries.<\/p>\n\n\n\n<p>There is an area of personal injury law known as <a href=\"https:\/\/www.justinian.com\/faqs\/#i-slipped-in-a-store-and-was-hurt-pretty-badly-what-do-i-need-to-know-and-how-can-i-get-compensation\"><em>premises liability<\/em><\/a>. They also must warn the customers if the unsafe condition is not easy to see.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-undocumented-workers-can-receive-workers-compensation\">Undocumented Workers Can Receive Workers\u2019 Compensation<\/h3>\n\n\n\n<p>Under Texas law, even if you are undocumented, workers\u2019 compensation insurance can pay for injuries you receive while working.<\/p>\n\n\n\n<p>The case of <a href=\"https:\/\/scholar.google.com\/scholar_case?case=1510627692701940018&amp;q=Commercial+Standard+Fire+and+Marine+Company+v.+Galindo&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">Commercial Standard Fire and Marine Company v. Galindo<\/a> showed that even undocumented workers are entitled to workers&#8217; compensation if they get hurt on the job.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1390\" height=\"359\" src=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/faq-content-6-image-3.jpg\" alt=\"\" class=\"wp-image-1367\" srcset=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/faq-content-6-image-3.jpg 1390w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/faq-content-6-image-3-540x139.jpg 540w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/faq-content-6-image-3-768x198.jpg 768w\" sizes=\"(max-width: 1390px) 100vw, 1390px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-plaintiffs-undocumented-status-cannot-be-used-to-discredit-them\">Plaintiffs\u2019 Undocumented Status Cannot Be Used to Discredit Them<\/h2>\n\n\n\n<p>When someone in a lawsuit gives evidence to the judge or jury by describing what happened, this is known as <em>testimony<\/em>. The person telling what happened is known as the <em>witness<\/em>. The witness <em>testifies<\/em> as to what they remember.<\/p>\n\n\n\n<p>Many times, the other side will try to discredit the witness. They will say the witness cannot be trusted. If the witness has been untruthful in the past &#8211; for example, if the witness submitted a forged document &#8211; the other side can point to that to tell the judge or jury the witness should not be trusted.<\/p>\n\n\n\n<p>However, in the case of <a href=\"https:\/\/scholar.google.com\/scholar_case?case=8054632664777695034&amp;q=+TXI+Transp.+Co.+v.+Hughes&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">TXI Transp. Co. v. Hughes<\/a>, 306 S.W.3d 230 (Tex. 2010), the Supreme Court of Texas ruled that witnesses\u2019 <em>immigration status<\/em> cannot be used in court to say they are not telling the truth. The Texas Supreme Court stated that:<\/p>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p><em>Appeals to racial and ethnic prejudices&#8230;cannot be tolerated because they undermine the very basis of the judicial process.<\/em><\/p><\/blockquote><\/figure>\n\n\n\n<p>That means even an undocumented plaintiff or witness can testify in a personal injury case.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-undocumented-victims-who-have-been-injured-can-hire-a-personal-injury-attorney\">Undocumented Victims Who Have Been Injured Can Hire a Personal Injury Attorney<\/h2>\n\n\n\n<p>It can be frightening to live as an undocumented worker in the U.S.<\/p>\n\n\n\n<p>Many immigrants do not speak English well.
