Courts look at a variety of factors to decide whether someone was being careful <em>enough<\/em>, or acting <em>negligently<\/em>.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<h3 class=\"wp-block-heading\" id=\"h-standard-of-care\">Standard of Care<\/h3>\n\n\n\n<p>In a negligence lawsuit, judges and juries decide how careful someone should have been. For example, if you are driving faster than the speed limit, a jury may assume you were driving at an <em>unsafe speed<\/em>.<\/p>\n\n\n\n<p>18-wheelers are heavily regulated motor vehicles. Truck drivers are also required to follow a lot of safety rules to receive and maintain their truck driving licenses.<\/p>\n\n\n\n<p>Therefore, proving an 18-wheeler driver caused an auto collision often includes showing that the trucker violated a safety requirement for truckers.<\/p>\n<\/div>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-safety-regulations-for-tractor-trailer-drivers-in-texas\">Safety Regulations for Tractor Trailer Drivers in Texas<\/h2>\n\n\n\n<p>Driving is dangerous enough without the risk of overtired truckers on the road. Truck drivers\u2019 hours on the road and how they must log those hours fall under federal law.<\/p>\n\n\n\n<p>Sometimes pressure from their employers to put profit ahead of safety makes some truckers break the hours of service (HOS) rules.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-14-hour-driving-window\">14-Hour Driving Window<\/h3>\n\n\n\n<p>A trucker that has been off duty for 10 or more hours in a row, is entitled to one 14-hour driving window.<\/p>\n\n\n\n<ul class=\"check-list wp-block-list\">\n<li>The 14-hour window begins as soon as the truck driver starts trucking-related work (e.g., loading).<\/li>\n\n\n\n<li>Taking time off (lunch break, nap), <em>does not extend the 14 hours<\/em>.<\/li>\n\n\n\n<li>The trucker\u2019s 14-hour driving window is sometimes called a \u201cdaily\u201d limit, but it is not based upon a 24-hour period.<\/li>\n\n\n\n<li>During the 14-hour window, a truck driver can drive up to 11 hours. This is known as the 11-Hour Driving Limit<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-11-hour-driving-limit\">11-Hour Driving Limit<\/h3>\n\n\n\n<p>After 8 hours of driving, the driver must have an off-duty or sleeping period of at least 30 minutes.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>During the 14-hour period, truckers are only allowed to drive a truck for up to 11 total hours.<\/li>\n\n\n\n<li>Drivers who have driven for a total of 11 hours must go off duty, even if the 14-Hour Driving Window is still ongoing. The driver has to be off duty for another 10 hours in a row before driving again.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-the-60-70-hour-limit\">The 60 \/ 70-Hour Limit<\/h3>\n\n\n\n<p>Drivers cannot drive after being on duty for 60 hours for the past 7 days (or 70 hours in the past 8 days).<\/p>\n\n\n\n<ul class=\"check-list wp-block-list\">\n<li>They must wait until enough days pass that they have driven less than 60 hours in the past 7 days.<\/li>\n\n\n\n<li>They may do other, non-driving work for the trucking company.<\/li>\n\n\n\n<li>Hours spent driving for other companies are included in calculating the 60 \/ 70 Hour Limit.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-center has-background has-small-font-size\" style=\"background-color:#f3f3f3\"><strong><strong>Note that<\/strong>, as of December 16, 2014, the rule that there must be a 34-hour off-duty period in order for drivers to restart their 60- or 70-hour clock calculations <a href=\"https:\/\/cms.fmcsa.dot.gov\/regulations\/hours-service\/hours-service-drivers\" target=\"_blank\" rel=\"noreferrer noopener\">has been suspended<\/a>.<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1320\" height=\"450\" src=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/11\/Safety-Regulations-for-Tractor-Trailer-Drivers-in-Austin.jpg\" alt=\"\" class=\"wp-image-1544\" srcset=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/11\/Safety-Regulations-for-Tractor-Trailer-Drivers-in-Austin.jpg 1320w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/11\/Safety-Regulations-for-Tractor-Trailer-Drivers-in-Austin-540x184.jpg 540w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/11\/Safety-Regulations-for-Tractor-Trailer-Drivers-in-Austin-768x262.jpg 768w\" sizes=\"(max-width: 1320px) 100vw, 1320px\" \/><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-daily-log\">Daily Log<\/h3>\n\n\n\n<p>Truck drivers must keep a daily log of their hours on duty. This is called a <em>record of duty status<\/em>.<\/p>\n\n\n\n<ul class=\"check-list wp-block-list\">\n<li>Drivers must make their own entries and complete two copies of a log with on\/off duty times.<\/li>\n\n\n\n<li>While there are some exceptions, the basic rule is that a driver&#8217;s log must cover all 24 hours of every day including days off.<\/li>\n\n\n\n<li>Authorized government inspectors can inspect a driver&#8217;s logs at any time to ensure the log contains no hours-of-service violations.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-100-air-mile-radius-exception\">100 Air-Mile Radius Exception<\/h3>\n\n\n\n<p>According to the FMCSA, there is an optional exception to the rules of maintaining a daily log for drivers who:<\/p>\n\n\n\n<ul class=\"check-list wp-block-list\">\n<li>Drive within a 100 air-mile radius of their normal work reporting location,<\/li>\n\n\n\n<li>Return to their work reporting location and are released within 12 consecutive hours, and<\/li>\n\n\n\n<li>Follow all other basic hours-of-service rules including the 10-hour off-duty and 11-hour driving rules.<\/li>\n<\/ul>\n\n\n\n<p>Drivers who meet these requirements can agree with their employers not to maintain a log.
