Although some researchers speculate it <a href=\"https:\/\/www.sciencedaily.com\/releases\/2020\/03\/200317175442.htm\" target=\"_blank\" rel=\"noreferrer noopener\">may have spread from an animal to humans<\/a>, the exact nature of the virus is an emerging unknown.<\/p>\n\n\n\n<p>Since the Covid-19 strain of the coronavirus was only first described in December 2019, immunology scientists, infectious disease experts have raced to study its effects in real time.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.sciencemag.org\/news\/2020\/03\/who-launches-global-megatrial-four-most-promising-coronavirus-treatments\" target=\"_blank\" rel=\"noreferrer noopener\">Cures<\/a> and <a href=\"https:\/\/www.raps.org\/news-and-articles\/news-articles\/2020\/3\/covid-19-vaccine-tracker\" target=\"_blank\" rel=\"noreferrer noopener\">vaccines<\/a> both still seem to be very much in the testing phase. <a href=\"https:\/\/wwwnc.cdc.gov\/eid\/article\/26\/6\/20-0233_article\" target=\"_blank\" rel=\"noreferrer noopener\">Early estimates<\/a> of the Covid-19 coronavirus\u2019 ability to survive on a surface are <a href=\"https:\/\/science.slashdot.org\/story\/20\/03\/25\/1619236\/cdc-says-coronavirus-rna-found-in-princess-cruise-ship-cabins-up-to-17-days-after-passengers-left\" target=\"_blank\" rel=\"noreferrer noopener\">continuously revised<\/a>, and its apparent susceptibility to heat lead some to <a href=\"https:\/\/www.smithsonianmag.com\/science-nature\/why-warm-weather-probably-wont-snuff-out-covid-19-180974482\/\" target=\"_blank\" rel=\"noreferrer noopener\">speculate that warmer weather<\/a> will help diminish the Coronavirus pandemic, although <a href=\"https:\/\/www.sciencemag.org\/news\/2020\/03\/ticking-time-bomb-scientists-worry-about-coronavirus-spread-africa\" target=\"_blank\" rel=\"noreferrer noopener\">Covid has been detected in Africa<\/a> and other<a href=\"https:\/\/www.who.int\/emergencies\/diseases\/novel-coronavirus-2019\/advice-for-public\/myth-busters\" target=\"_blank\" rel=\"noreferrer noopener\"> places with hot and humid weather<\/a>.<\/p>\n\n\n\n<p>With <a href=\"https:\/\/www.who.int\/emergencies\/diseases\/novel-coronavirus-2019\/events-as-they-happen\" target=\"_blank\" rel=\"noreferrer noopener\">the data in flux<\/a>, everyone from physicians to politicians to pundits seems to dispute exactly how much risk Covid-19 poses, and <a href=\"https:\/\/reason.com\/2020\/03\/25\/is-preventing-covid-19-deaths-worth-a-severe-recession-the-answer-depends-on-controversial-assumptions-about-the-epidemics-lethality\/\" target=\"_blank\" rel=\"noreferrer noopener\">whether that risk justifies<\/a> the stoppages and economic harms that will <a href=\"https:\/\/www.goldmansachs.com\/insights\/pages\/gs-research\/us-daily-20-mar-2020\/report.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">likely be incurred<\/a> by measures such as <a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/faq.html\" target=\"_blank\" rel=\"noreferrer noopener\">lockdowns and quarantines<\/a>.<\/p>\n<\/div>\n<\/div>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1430\" height=\"510\" src=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/Misinformation-And-The-Covid-19-coronavirus.jpg\" alt=\"\" class=\"wp-image-822\" srcset=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/Misinformation-And-The-Covid-19-coronavirus.jpg 1430w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/Misinformation-And-The-Covid-19-coronavirus-540x193.jpg 540w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/Misinformation-And-The-Covid-19-coronavirus-768x274.jpg 768w\" sizes=\"(max-width: 1430px) 100vw, 1430px\" \/><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-misinformation-and-the-covid-19-coronavirus\">Misinformation And The Covid-19 coronavirus<\/h3>\n\n\n\n<p>Beyond the many scientific unknowns concerning this strain of Coronavirus, political considerations have influenced reports of the risks and realities of Covid-19, including even what to call the virus.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-the-people-s-republic-of-china-and-underreporting-of-the-covid-19-coronavirus\">The People\u2019s Republic of China and Underreporting of the COVID-19 Coronavirus<\/h3>\n\n\n\n<p>Officials in the People\u2019s Republic of China appear to have <a href=\"https:\/\/www.axios.com\/timeline-the-early-days-of-chinas-coronavirus-outbreak-and-cover-up-ee65211a-afb6-4641-97b8-353718a5faab.html\" target=\"_blank\" rel=\"noreferrer noopener\">ignored and deleted doctors\u2019 warnings<\/a> of an unconventional pneumonia when it first appeared in Central China. The country\u2019s alleged cover up <a href=\"https:\/\/www.axios.com\/timeline-the-early-days-of-chinas-coronavirus-outbreak-and-cover-up-ee65211a-afb6-4641-97b8-353718a5faab.html\" target=\"_blank\" rel=\"noreferrer noopener\">may have allowed<\/a> the virus to spread to other Asian countries and beyond.<\/p>\n\n\n\n<p>Accordingly, parties emphasizing China\u2019s role in the spread of the virus refer to Covid-19 as the \u201cWuhan Virus.\u201d Such a moniker likely also helps de-emphasize their own delay in identifying and responding to the growth of Covid-19 from local matter to global pandemic.<\/p>\n\n\n\n<p>Even the World Health Organization (WHO) has grappled with Covid-19 coronavirus misinformation, <a rel=\"noreferrer noopener\" href=\"https:\/\/www.washingtonexaminer.com\/opinion\/op-eds\/world-health-organization-protects-china-instead-of-coronavirus-victims\" target=\"_blank\">receiving criticism<\/a> for <a rel=\"noreferrer noopener\" href=\"https:\/\/twitter.com\/WHO\/status\/1217043229427761152?s=20\" target=\"_blank\">repeating<\/a> China\u2019s initial downplaying of the virus, and naming the disease <a rel=\"noreferrer noopener\" href=\"https:\/\/qz.com\/1820422\/coronavirus-why-wont-who-use-the-name-sars-cov-2\/\" target=\"_blank\">to avoid reference to<\/a> its genetic cousin, the <a rel=\"noreferrer noopener\" href=\"https:\/\/www.nature.com\/articles\/nrmicro775\" target=\"_blank\">SARS virus<\/a> that became <a rel=\"noreferrer noopener\" href=\"https:\/\/science.sciencemag.org\/content\/300\/5627\/1884\" target=\"_blank\">epidemic<\/a> in 2003.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-medical-information-is-often-misreported\">Medical Information Is Often Misreported<\/h3>\n\n\n\n<p>Beyond political considerations, <a href=\"https:\/\/onlinelibrary.wiley.com\/doi\/full\/10.1111\/eci.12834\" target=\"_blank\" rel=\"noreferrer noopener\">healthcare misinformation<\/a> is already its own kind of epidemic, and accordingly <a href=\"https:\/\/www.who.int\/emergencies\/diseases\/novel-coronavirus-2019\/advice-for-public\/myth-busters\" target=\"_blank\" rel=\"noreferrer noopener\">myths<\/a> about Covid-19\u2019s origin, nature and possible preventive measures or remedies have been <a href=\"https:\/\/www.jhsph.edu\/covid-19\/articles\/coronavirus-facts-vs-myths.html\" target=\"_blank\" rel=\"noreferrer noopener\">widespread<\/a>.<\/p>\n\n\n\n<p>Thus, while researchers and those on the front lines of Covid-19 have made tremendous accomplishments in combating the virus, a great deal remains unknown about it, and uncertainty may prove a major obstacle to sanctioning a Covid-19 transmission under the law.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<h2 class=\"wp-block-heading\" id=\"h-a-covid-19-coronavirus-transmission-might-give-rise-to-liability-in-texas\">A Covid-19 Coronavirus Transmission Might Give Rise To Liability In Texas<\/h2>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p>There are a number of legal theories under which a defendant\u2019s transmission of the Covid-19 virus to another might be sanctionable, nationally and in Texas specifically, under both criminal and tort regimes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-background-to-legal-liability-for-infection\">Background To Legal Liability For Infection<\/h3>\n\n\n\n<p id=\"h-by-the-1900s-the-germ-theory-of-infection-was-largely-accepted-and-since-the-beginning-of-the-20th-century-united-states-courts-have-recognized-that-a-battery-an-offensive-touching-can-take-place-without-direct-bodily-contact-by-transmitting-a-poison-or-an-infection-even-in-1917-a-husband-was-convicted-of-criminal-assault-for-concealing-from-his-wife-that-he-had-syphilis-his-wife-s-consent-to-sexual-intercourse-was-held-invalid-because-she-was-unaware-he-carried-the-disease\">By the 1900s, the <a href=\"http:\/\/ftp.columbia.edu\/itc\/hs\/pubhealth\/p8475\/readings\/lederberg.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">germ theory<\/a> of infection <a href=\"https:\/\/books.google.com\/books?hl=en&amp;lr=&amp;id=3Yk2ylBmmtsC&amp;oi=fnd&amp;pg=PR11&amp;dq=germ+theory+history+1900s&amp;ots=uyR4kCbqps&amp;sig=LF8Kz2Thq-ylt-DJwvTaNzCEbGc#v=onepage&amp;q=acceptance&amp;f=false\" target=\"_blank\" rel=\"noreferrer noopener\">was largely accepted<\/a>, and since the beginning of the 20th century, United States courts have recognized that a battery (an offensive touching) can take place <a href=\"https:\/\/scholar.google.com\/scholar_case?case=4836617679234507916&amp;hl=en&amp;as_sdt=2005&amp;sciodt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">without direct bodily contact<\/a> by transmitting a <a href=\"https:\/\/www.casemine.com\/judgement\/us\/5914aaddadd7b0493472b1a8\" target=\"_blank\" rel=\"noreferrer noopener\">poison<\/a> or an <a href=\"https:\/\/scholar.google.com\/scholar_case?about=6216657868017914429&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">infection<\/a>. Even in 1917, a husband was convicted of criminal assault for <a href=\"https:\/\/scholar.google.com\/scholar_case?about=6216657868017914429&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">concealing from his wife that he had syphilis<\/a>. His wife\u2019s consent to sexual intercourse was held invalid because she was unaware he carried the disease.<\/p>\n\n\n\n<p>As the body of human scientific understanding and germs themselves have grown, civil torts have been well-recognized under <a href=\"https:\/\/www.justinian.com\/how-were-you-injured\/texas-tort-law\/\">negligence theories<\/a> for the transmission of <a rel=\"noreferrer noopener\" href=\"https:\/\/scholarlycommons.law.hofstra.edu\/cgi\/viewcontent.cgi?article=1652&amp;context=hlr\" target=\"_blank\">gonorrhea, herpes and HIV<\/a>. Liability has also been proposed and applied to transmitting an infectious disease <a rel=\"noreferrer noopener\" href=\"https:\/\/scholarlycommons.law.hofstra.edu\/cgi\/viewcontent.cgi?article=1652&amp;context=hlr\" target=\"_blank\">under misrepresentation and fraud theories<\/a>. Under nationwide and <a rel=\"noreferrer noopener\" href=\"https:\/\/statutes.capitol.texas.gov\/\" target=\"_blank\">Texas state civil<\/a> and <a rel=\"noreferrer noopener\" href=\"https:\/\/statutes.capitol.texas.gov\/?link=PE\" target=\"_blank\">criminal law<\/a>, such theories of legal liability might apply to a transmission of the Covid-19 virus.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-transmitting-covid-19-in-texas-might-be-a-negligent-or-intentional-battery\">Transmitting Covid-19 in Texas Might Be a Negligent or Intentional Battery<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-the-duty-to-warn\">The Duty To Warn<\/h4>\n\n\n\n<p>A <a href=\"https:\/\/www.justinian.com\/how-were-you-injured\/mass-tort-litigation\/\">duty to warn<\/a> of an infectious condition <a rel=\"noreferrer noopener\" href=\"https:\/\/www.law.uh.edu\/healthlaw\/perspectives\/Tort\/980312Duty.html\" target=\"_blank\">has been imposed<\/a> upon carrier-defendants in negligence cases. Carriers of an infection need not expressly lie about their condition, simply saying nothing about it can <a rel=\"noreferrer noopener\" href=\"https:\/\/scholar.google.com\/scholar_case?case=4910261402787190935&amp;q=%2Btort+%2B%22transmission+of%22+%2Bdisease+&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\">breach the standard of care they owe<\/a> to others who might foreseeably be exposed.<\/p>\n\n\n\n<p>Although a <em>physician<\/em>\u2019s duty to warn <a rel=\"noreferrer noopener\" href=\"https:\/\/scholar.google.com\/scholar_case?case=14075460389722298481&amp;q=Doe+v.+Cochran,+62+Conn+L+Rptr+33,+2016+(S.C.+%2319879).&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\">generally applies<\/a> only to a patient, in the case of communicable disease, doctors often have duty to warn (either directly or via public agencies) third parties who are foreseeably at risk of exposure, including <a rel=\"noreferrer noopener\" href=\"https:\/\/www.mdedge.com\/internalmedicine\/article\/201909\/business-medicine\/legal-duty-nonpatients-communicable-diseases\" target=\"_blank\">the patient\u2019s family<\/a>.<\/p>\n\n\n\n<p>Complicating the situation that doctors\u2019 duty to warn is at odds with their obligation to preserve a patient\u2019s <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pubmed\/16607711\" target=\"_blank\" rel=\"noreferrer noopener\">confidentiality<\/a>, a dilemma faced by medical practitioners whose patients test positive for HIV and <a href=\"https:\/\/pdfs.semanticscholar.org\/2943\/137607d9650b8db024fbfcc61b813eeca025.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">neglect or refuse to warn<\/a> their cohabitants or sexual partners.<\/p>\n<\/div>\n<\/div>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1430\" height=\"510\" src=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/A-Covid-19-Coronavirus-Transmission-Might-Give-Rise-To-Liability-In-Texas.jpg\" alt=\"\" class=\"wp-image-821\" srcset=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/A-Covid-19-Coronavirus-Transmission-Might-Give-Rise-To-Liability-In-Texas.jpg 1430w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/A-Covid-19-Coronavirus-Transmission-Might-Give-Rise-To-Liability-In-Texas-540x193.jpg 540w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/A-Covid-19-Coronavirus-Transmission-Might-Give-Rise-To-Liability-In-Texas-768x274.jpg 768w\" sizes=\"(max-width: 1430px) 100vw, 1430px\" \/><figcaption>Referencial<\/figcaption><\/figure>\n\n\n\n<p><a href=\"https:\/\/www.courtlistener.com\/opinion\/2443048\/flores-v-lively\/\" target=\"_blank\" rel=\"noreferrer noopener\">Civil tort law in Texas<\/a> and <a rel=\"noreferrer noopener\" href=\"https:\/\/www.casemine.com\/search\/us\/negligence%20herpes\" target=\"_blank\">many other states<\/a> recognizes a court claim for <a href=\"https:\/\/www.justinian.com\/how-were-you-injured\/texas-tort-law\/\">damages<\/a> on the basis of <a rel=\"noreferrer noopener\" href=\"https:\/\/scholar.google.com\/scholar_case?case=15563390711846890007&amp;q=STATE+FARM+FIRE+%26+CASUALTY+COMPANY+vs.+ss&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\">negligent or intentional<\/a> transmission of a sexually transmitted disease, <a rel=\"noreferrer noopener\" href=\"https:\/\/law.justia.com\/cases\/texas\/supreme-court\/1987\/c-5220-0.html\" target=\"_blank\">even within a marriage<\/a>. Some have even <a rel=\"noreferrer noopener\" href=\"https:\/\/scholarship.law.umn.edu\/cgi\/viewcontent.cgi?article=1629&amp;context=mlr\" target=\"_blank\">advocated for strict liability<\/a> to apply to transmissions of a sexually transmitted disease, placing the burden on carriers to disclose adequately to their sex partners that engaging in such behavior involves the risk of contracting a disease.<\/p>\n\n\n\n<p>Furthermore, <a rel=\"noreferrer noopener\" href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/HS\/htm\/HS.81.htm\" target=\"_blank\">under Texas state law<\/a>, although adult patients are permitted to refuse medical care for reasons of faith, <a rel=\"noreferrer noopener\" href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/HS\/htm\/HS.81.htm\" target=\"_blank\">even in the case of a communicable disease<\/a>, they <em>must comply with official quarantines<\/em> or face liability, and failing to do so might constitute <a href=\"https:\/\/www.justinian.com\/how-were-you-injured\/texas-tort-law\/\">negligence per se<\/a>.<\/p>\n\n\n\n<p>Thus at least theoretically, there are several ways in which contracting or transmitting the Covid-19 coronavirus might give rise to civil legal liability, even unintentionally if the Covid-19 carrier or a physician failed to warn, or the carrier acted recklessly in exposing others. In keeping with <a href=\"https:\/\/scholar.smu.edu\/cgi\/viewcontent.cgi?article=2307&amp;context=smulr\" target=\"_blank\" rel=\"noreferrer noopener\">general negligence principles<\/a>, under Texas case law, the statute of limitations on a civil action for the transmission of an infection begins to run once the recipient <a href=\"https:\/\/scholar.google.com\/scholar_case?case=4752552673229707885&amp;q=%22Flores+v.+Lively%22+texas+1991&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">becomes informed of<\/a> having contracted the infection.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-knowingly-transmitting-covid-19-to-someone-in-texas-might-be-criminal\">Knowingly Transmitting Covid-19 To Someone In Texas Might Be Criminal<\/h3>\n\n\n\n<p>In traditional common law, the use of a deadly weapon during an assault was offered as evidence of the assaulting party\u2019s <a rel=\"noreferrer noopener\" href=\"https:\/\/www.law.cornell.edu\/wex\/mens_rea\" target=\"_blank\">state of mind<\/a>; defendants\u2019 willingness to use a tool or method that <em>might<\/em> cause death or grievous bodily harm supported inferring they had <em>intended<\/em> to do so.<\/p>\n\n\n\n<p>Thus use of a deadly weapon during assault thus represented an <a href=\"https:\/\/casetext.com\/case\/sofge-v-state\" target=\"_blank\" rel=\"noreferrer noopener\">elevated degree of severity<\/a>.<\/p>\n\n\n\n<p>Similarly, <a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/PE\/htm\/PE.22.htm\" target=\"_blank\" rel=\"noreferrer noopener\">under Texas criminal law<\/a>, use of a deadly weapon during the commission of an assault <a href=\"https:\/\/casetext.com\/case\/sofge-v-state\" target=\"_blank\" rel=\"noreferrer noopener\">enhances the seriousness<\/a> of the crime to <a href=\"https:\/\/www.merriam-webster.com\/dictionary\/aggravated%20assault\" target=\"_blank\" rel=\"noreferrer noopener\">aggravated assault<\/a>, <a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/PE\/htm\/PE.12.htm\" target=\"_blank\" rel=\"noreferrer noopener\">a second class felony punishable by up to twenty years in jail<\/a> under the Texas sentencing guidelines.<\/p>\n\n\n\n<p>As recently as 2006, both <a href=\"https:\/\/scholar.google.com\/scholar_case?case=12783172156530437304&amp;q=Weeks+v.+State,+834+S.W.2d+559+(Tex.+App.+1992)%27&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">saliva<\/a> and <a href=\"https:\/\/scholar.google.com\/scholar_case?case=14819172900632359434&amp;q=Mathonican+v.+State,+194+S.W.3d+59+(Tex.+App.+2006)&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">seminal fluid<\/a> containing <a href=\"https:\/\/www.cdc.gov\/mmwr\/preview\/mmwrhtml\/ss5506a1.htm\" target=\"_blank\" rel=\"noreferrer noopener\">the HIV virus<\/a> have been deemed deadly weapons for purposes of aggravated assault in Texas. In fact, actual transmission of the disease is <a href=\"https:\/\/scholar.google.com\/scholar_case?case=12783172156530437304&amp;q=Weeks+v.+State,+834+S.W.2d+559+(Tex.+App.+1992)%27&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">not required<\/a> to constitute use of a deadly weapon.<\/p>\n\n\n\n<p>As <a href=\"https:\/\/scholar.google.com\/scholar_case?case=14819172900632359434&amp;q=Mathonican+v.+State,+194+S.W.3d+59+(Tex.+App.+2006)&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">the Texas Appellate Court noted<\/a>, aggravated assault law \u201cdoes not require that a deadly weapon actually be used against anyone or even that anyone be in a \u2018zone of danger,\u2019 but merely that a deadly weapon be exhibited or used and that someone be in some danger.\u201d Moreover, objects that are not traditionally thought of as weapons <em>can become deadly weapons<\/em> if they are used in a manner likely to cause <a href=\"https:\/\/scholar.google.com\/scholar_case?case=11788686407319427532&amp;q=Mathonican+v.+State,+194+S.W.3d+59+(Tex.+App.+2006)&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">death or bodily injury<\/a>.<\/p>\n\n\n\n<p>Therefore knowingly or recklessly transmitting the Covid-19 coronavirus to someone in Texas during an assault might constitute aggravated assault under Texas civil and criminal law.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-proving-a-criminal-or-civil-case-for-exposure-to-covid-19\">Proving A Criminal or Civil Case for Exposure To COVID-19<\/h3>\n\n\n\n<p>As with all legal cases <a href=\"https:\/\/digitalcommons.law.yale.edu\/cgi\/viewcontent.cgi?article=7745&amp;context=ylj\" target=\"_blank\" rel=\"noreferrer noopener\">sanctioning the transmission of an infection<\/a>, collecting and presenting evidence to prove the elements is complicated by the fact that <a href=\"https:\/\/www.nature.com\/articles\/d41586-020-00660-x\" target=\"_blank\" rel=\"noreferrer noopener\">the events are intangible and material evidence is microscopic<\/a>.<\/p>\n\n\n\n<p>Even among scientific experts, many questions about Covid-19 remain, including the virus\u2019 effects and manner of transmission. Even confirming that an individual has contracted the disease has been a point of controversy, and <a href=\"https:\/\/www.nationalreview.com\/news\/china-supplied-faulty-coronavirus-test-kits-to-spain-czech-republic\/\" target=\"_blank\" rel=\"noreferrer noopener\">several countries<\/a> have reported that <a href=\"https:\/\/filipinotimes.net\/news\/2020\/03\/28\/doh-some-donated-covid-19-test-kits-from-china-only-40-accurate\/\" target=\"_blank\" rel=\"noreferrer noopener\">tests thought to be reliable are failing<\/a> to detect up to <a href=\"https:\/\/www.businessinsider.com\/coronavirus-spain-says-rapid-tests-sent-from-china-missing-cases-2020-3\" target=\"_blank\" rel=\"noreferrer noopener\">seventy-percent of actual positive cases of Covid-19 coronavirus<\/a>.<\/p>\n\n\n\n<p>This lack of certainty in the factual record presents a significant challenge to proving elements such as <a rel=\"noreferrer noopener\" href=\"https:\/\/dictionary.thelaw.com\/mens-rea\/\" target=\"_blank\">mental state<\/a> and <a href=\"https:\/\/www.justinian.com\/how-were-you-injured\/texas-tort-law\/\">causation<\/a> in a criminal prosecution or civil action against a defendant who transmitted the Covid-19 coronavirus.<\/p>\n\n\n\n<p>Showing that a person with Covid-19 <a href=\"https:\/\/www.justinian.com\/how-were-you-injured\/texas-tort-law\/\">breached<\/a> a <a href=\"https:\/\/www.justinian.com\/how-were-you-injured\/mass-tort-litigation\/\">duty of care<\/a> by ignoring a foreseeable risk may prove problematic when <a rel=\"noreferrer noopener\" href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/prevent-getting-sick\/how-covid-spreads.html\" target=\"_blank\">even healthcare experts still have questions<\/a> how Covid-19 coronavirus can be transmitted. As stated, much is unknown about the Covid-19 virus and its characteristics, <a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/need-extra-precautions\/pregnancy-breastfeeding.html?CDC_AA_refVal=https%3A%2F%2Fwww.cdc.gov%2Fcoronavirus%2F2019-ncov%2Fprepare%2Fpregnancy-breastfeeding.html\" target=\"_blank\" rel=\"noreferrer noopener\">particularly the details of its transmission<\/a>. Accordingly, a veritable cottage industry of <a href=\"https:\/\/www.un.org\/press\/en\/2020\/sgsm20026.doc.htm\" target=\"_blank\" rel=\"noreferrer noopener\">misinformation<\/a> and <a href=\"https:\/\/www.medscape.com\/viewarticle\/926744\" target=\"_blank\" rel=\"noreferrer noopener\">home remedies<\/a> has sprung up in its wake.<\/p>\n\n\n\n<p>Such misinformation might provide wiggle room for a defendant who negligently or intentionally transmitted the Covid-19 virus, but <a rel=\"noreferrer noopener\" href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/cases-updates\/cases-in-us.html\" target=\"_blank\">people who know they have Covid-19<\/a> have likely been <a rel=\"noreferrer noopener\" href=\"https:\/\/www.mayoclinic.org\/diseases-conditions\/coronavirus\/symptoms-causes\/syc-20479963\" target=\"_blank\">informed by medical professionals<\/a> and government that they should be isolated.<\/p>\n\n\n\n<p>Even where carrier-defendants were unaware they had the disease, with potentially life-threatening conditions like HIV+, some courts have imposed liability on behavior and interactions that the defendant <a href=\"https:\/\/scholar.google.com\/scholar_case?case=17353433426921451372&amp;q=tort+%22transmission+of%22+%22disease%22&amp;hl=en&amp;as_sdt=1ffffffffffffffffffffffffffffffffe000000000000001f000001ffffffecfff87fe3fffffff00108010000000000004\" target=\"_blank\" rel=\"noreferrer noopener\">ought to have known<\/a> would place a plaintiff at substantial risk of contracting the disease.<\/p>\n\n\n\n<p>People who have been given a diagnosis of Covid-19 thus might incur liability if they neglected to isolate themselves in contradiction of medical recommendations, even more if state or local orders are issued establishing social distancing guidelines to be observed by everyone. Such laws have already been used to <a href=\"https:\/\/www.ocregister.com\/2020\/03\/28\/1-surfer-cited-but-most-people-compliant-at-closed-restricted-beaches-across-southern-california\/\" target=\"_blank\" rel=\"noreferrer noopener\">sanction<\/a> even healthy violators of isolation orders, and the idea that someone doing so <em>knowing they are carrying Covid-19<\/em> might be subject to legal liability seems plausible and reasonable without constituting overreaching.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<h3 class=\"wp-block-heading\" id=\"h-symptoms-of-covid-19-and-a-personal-injury-lawsuit-for-infection\">Symptoms of COVID-19 and a Personal Injury Lawsuit for Infection<\/h3>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p>A closer case might involve someone who only has <em>symptoms<\/em> associated with Covid-19, but also neglects to isolate themselves, particularly against the orders of healthcare providers or state and local officials. Thus defendants might reasonably argue that they did not really believe that Covid-19 posed a big risk, and understood the alarm expressed around the virus to be overblown.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<h2 class=\"wp-block-heading\" id=\"h-proving-causation-in-a-legal-action-for-covid-19-coronavirus-transmission\">Proving Causation In A Legal Action For Covid-19 Coronavirus Transmission<\/h2>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p>Perhaps the largest challenge would lie in demonstrating that Defendant had transmitted the infection to Plaintiff. Tracing the origin of an individual\u2019s contracting the virus might involve too many nodes.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-however-proving-causation-is-a-function-of-the-particular-facts-and-evidence\">However, proving causation is a function of the particular facts and evidence.<\/h3>\n\n\n\n<p>Thus people whose efforts to practice social distancing were momentarily stymied by a Covid-19 carrier\u2019s intentionally or reckless exposing them to the virus might have a more convincing case.
