The virus was <a href=\"https:\/\/books.google.com\/books?hl=en&amp;lr=&amp;id=ZQMW-S0MRjkC&amp;oi=fnd&amp;pg=PA13&amp;dq=yellow+fever+name+came+from&amp;ots=jCZQtXjn20&amp;sig=9nOCzm2SjJbIEpeIn5msVgUP-0U#v=onepage&amp;q=yellow%20fever%20name%20came%20from&amp;f=false\" target=\"_blank\" rel=\"noreferrer noopener\">described by Spanish conquistadors<\/a> in the Americas as early as 1648, with ongoing appearances in the <a href=\"https:\/\/books.google.com\/books?hl=en&amp;lr=&amp;id=ZQMW-S0MRjkC&amp;oi=fnd&amp;pg=PA13&amp;dq=yellow+fever+name+came+from&amp;ots=jCZQtXjn20&amp;sig=9nOCzm2SjJbIEpeIn5msVgUP-0U#v=onepage&amp;q=yellow%20fever%20name%20came%20from&amp;f=false\" target=\"_blank\" rel=\"noreferrer noopener\">English colonies<\/a>, but in 1798, epidemics broke out in Boston, Philadelphia and New York, <a href=\"https:\/\/books.google.com\/books?hl=en&amp;lr=&amp;id=XltNAAAAYAAJ&amp;oi=fnd&amp;pg=PA1&amp;dq=1798+yellow+fever+mortality+rates+&amp;ots=rbgALbIJDx&amp;sig=fgnii6EHkRPYvQYAgfvmbIHxUhU#v=onepage&amp;q=1798%20yellow%20fever%20mortality%20rates&amp;f=false\" target=\"_blank\" rel=\"noreferrer noopener\">decimating 5-8% of the cities\u2019 populations<\/a> in a single year.<\/p>\n\n\n\n<p>In addition to fever, nausea, discomfort, facial bleeding and eventually organ failure, symptoms included jaundiced skin, <a href=\"https:\/\/books.google.com\/books?hl=en&amp;lr=&amp;id=ZQMW-S0MRjkC&amp;oi=fnd&amp;pg=PA13&amp;dq=yellow+fever+name+came+from&amp;ots=jCZQtXjn20&amp;sig=9nOCzm2SjJbIEpeIn5msVgUP-0U#v=onepage&amp;q=yellow%20fever%20name%20came%20from&amp;f=false\" target=\"_blank\" rel=\"noreferrer noopener\">earning it the nickname<\/a> \u201cYellow Fever.\u201d <a href=\"https:\/\/books.google.com\/books?hl=en&amp;lr=&amp;id=ZQMW-S0MRjkC&amp;oi=fnd&amp;pg=PA13&amp;dq=yellow+fever+name+came+from&amp;ots=jCZQtXjn20&amp;sig=9nOCzm2SjJbIEpeIn5msVgUP-0U#v=onepage&amp;q=yellow%20fever%20name%20came%20from&amp;f=false\" target=\"_blank\" rel=\"noreferrer noopener\">Many mysteries<\/a> surrounded the illness, but physicians <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC2272343\/pdf\/pubhealthpap00025-0197.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">had deduced<\/a> that the virus was <a href=\"https:\/\/books.google.com\/books?id=2XbHXUVY65gC&amp;pg=PA103#v=onepage&amp;q&amp;f=false\" target=\"_blank\" rel=\"noreferrer noopener\">arriving via seaports<\/a>, principally ships from the Carribean. Without any means to <a href=\"https:\/\/babel.hathitrust.org\/cgi\/pt?id=njp.32101065216887&amp;view=1up&amp;seq=648\" target=\"_blank\" rel=\"noreferrer noopener\">combat or cure<\/a> Yellow Fever, sanitation and <a href=\"https:\/\/books.google.com\/books?id=2XbHXUVY65gC&amp;pg=PA103#v=onepage&amp;q&amp;f=false\" target=\"_blank\" rel=\"noreferrer noopener\">quarantines<\/a> became the favored tools of prevention.<\/p>\n\n\n\n<p>Quarantines <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC1750233\/pdf\/bullnyacadmed00243-0099.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">proved effective<\/a> in the Northeastern U.S., but a relentless spate of outbreaks plagued the the American South. The <a href=\"https:\/\/scholarship.law.upenn.edu\/cgi\/viewcontent.cgi?article=1615&amp;context=jcl\" target=\"_blank\" rel=\"noreferrer noopener\">yellow quarantine flags<\/a> frequently seen flying on ships in the Mississippi Delta earned the virus <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC2892770\/\" target=\"_blank\" rel=\"noreferrer noopener\">local nicknames<\/a> like \u201cYellow Jack\u201d and \u201cBronze John.\u201d<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:20%\">\n<h2 class=\"wp-block-heading\" id=\"h-viral-panic\">Viral Panic<\/h2>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p>The first response to an outbreak of Yellow Fever was often a mass exodus from cities and other infected regions, and in <a rel=\"noreferrer noopener\" href=\"https:\/\/books.google.com\/books?hl=en&amp;lr=&amp;id=DmWTBAAAQBAJ&amp;oi=fnd&amp;pg=PP1&amp;dq=1793+Quarantine+Act+&amp;ots=4iFW85QHBa&amp;sig=lGi4hNV1HUjvsVEcFDRpVdNPJ6E#v=onepage&amp;q=quarantine&amp;f=false\" target=\"_blank\">some cases<\/a> legislators themselves just handed over power to the executive and left town. Alarmed that the trains were filled with infected passengers and cargo, many states issued quarantines against regions and even entire states, and at one point Mississippi banned any and all entry, from anywhere, whatsoever.<\/p>\n\n\n\n<p>In fact, <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC1750233\/pdf\/bullnyacadmed00243-0099.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">railroads had extended the reach of Yellow Fever<\/a> throughout the South by moving people and livestock, and local communities were rightly concerned. Epidemics were <a href=\"https:\/\/digitalcommons.lsu.edu\/cgi\/viewcontent.cgi?article=1665&amp;context=gradschool_disstheses\">frequent<\/a> and <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC1750233\/pdf\/bullnyacadmed00243-0099.pdf\">lethal<\/a>, and with the best efforts of <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC1750233\/pdf\/bullnyacadmed00243-0099.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">physicians<\/a> and <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC2272343\/pdf\/pubhealthpap00025-0197.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">state authorities<\/a> unable to stem the tide of Yellow Fever, the process quickly devolved into local self-help that a <a href=\"https:\/\/chroniclingamerica.loc.gov\/lccn\/sn84031492\/1879-04-08\/ed-1\/seq-9\/\" target=\"_blank\" rel=\"noreferrer noopener\">Chicago journalist<\/a> dubbed \u201cshotgun quarantines.\u201d<\/p>\n<\/div>\n<\/div>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1430\" height=\"450\" src=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/viral-panic-image.jpg\" alt=\"\" class=\"wp-image-388\" srcset=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/viral-panic-image.jpg 1430w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/viral-panic-image-540x170.jpg 540w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/viral-panic-image-768x242.jpg 768w\" sizes=\"(max-width: 1430px) 100vw, 1430px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-rise-of-shotgun-quarantines\">The Rise of \u201cShotgun Quarantines\u201d<\/h2>\n\n\n\n<p>Despite the image they conjure of vigilante groups, shotgun quarantines were generally ordered by <a href=\"https:\/\/scholarship.law.upenn.edu\/cgi\/viewcontent.cgi?article=1615&amp;context=jcl\" target=\"_blank\" rel=\"noreferrer noopener\">local authorities<\/a> such as town councils, and enforced by an armed citizenry deputized by the Sheriff. Shotgun quarantines <a href=\"https:\/\/scholarship.law.upenn.edu\/cgi\/viewcontent.cgi?article=1615&amp;context=jcl\" target=\"_blank\" rel=\"noreferrer noopener\">involved<\/a> guarding entry points to a cordoned area, both on foot and in boats, arresting people trying to enter or leave, and preventing the unloading of cargo and passengers from trains.<\/p>\n\n\n\n<p>States and localities passed laws establishing the rights of communities to impose local quarantines, and while they were <a href=\"https:\/\/scholarship.law.upenn.edu\/cgi\/viewcontent.cgi?article=1615&amp;context=jcl\" target=\"_blank\" rel=\"noreferrer noopener\">criticized by many<\/a>, others <a href=\"https:\/\/www.newspapers.com\/image\/?clipping_id=11781665&amp;fcfToken=eyJhbGciOiJIUzI1NiIsInR5cCI6IkpXVCJ9.eyJmcmVlLXZpZXctaWQiOjI2OTI2MzkyLCJpYXQiOjE1ODYwNDE2NjksImV4cCI6MTU4NjEyODA2OX0.LWvCdMV6N5_SBTNl7Cxi1qTyTlLGgNl98cjPyxOEP0s\" target=\"_blank\" rel=\"noreferrer noopener\">acknowledged<\/a> the fear felt by communities learning about the virus\u2019 rising body count. Some even shared the local residents\u2019 <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC1750233\/pdf\/bullnyacadmed00243-0099.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">indignation<\/a> that state authorities had failed to prevent another outbreak, and while the real culprit was usually <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC2892770\/\" target=\"_blank\" rel=\"noreferrer noopener\">ignorance<\/a> and primitive <a href=\"http:\/\/ftp.columbia.edu\/itc\/hs\/pubhealth\/p8475\/readings\/lederberg.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">germ theory<\/a>, in some cases the townsfolk were right.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:20%\">\n<h2 class=\"wp-block-heading\" id=\"h-yellow-fever-and-fake-news\">Yellow Fever And Fake News<\/h2>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<p>New Orleans officials, physicians and newspapers were frequently <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC1750233\/pdf\/bullnyacadmed00243-0099.pdf\">dishonest<\/a> about the reality of an outbreak, worried about its effect on commerce. They <a href=\"https:\/\/digitalcommons.lsu.edu\/cgi\/viewcontent.cgi?article=1665&amp;context=gradschool_disstheses\" target=\"_blank\" rel=\"noreferrer noopener\">blamed<\/a> outsiders and the poor, assuring the world that cleaner and more responsible individuals had little to worry about.<\/p>\n\n\n\n<p>Although no one was yet aware, the virus\u2019 African origins did in fact mean that new arrivals to the port were <a href=\"https:\/\/books.google.com\/books?hl=en&amp;lr=&amp;id=XltNAAAAYAAJ&amp;oi=fnd&amp;pg=PA1&amp;dq=1798+yellow+fever+mortality+rates+&amp;ots=rbgALbIJDx&amp;sig=fgnii6EHkRPYvQYAgfvmbIHxUhU#v=onepage&amp;q=1798%20yellow%20fever%20mortality%20rates&amp;f=false\" target=\"_blank\" rel=\"noreferrer noopener\">more susceptible<\/a> to contracting it, but when Yellow Jack <a href=\"https:\/\/digitalcommons.lsu.edu\/cgi\/viewcontent.cgi?article=1665&amp;context=gradschool_disstheses\" target=\"_blank\" rel=\"noreferrer noopener\">reached wealthier, established areas<\/a> of the city, the virus proved equally destructive.<\/p>\n\n\n\n<p>Months before one paper <a rel=\"noreferrer noopener\" href=\"https:\/\/books.google.com\/books\/about\/Cohen_s_New_Orleans_Directory.html?id=GkIKtwAACAAJ\" target=\"_blank\">claimed the disease was considered obsolete<\/a> by physicians, New Orleans\u2019 yellow fever mortality rate <a href=\"https:\/\/digitalcommons.lsu.edu\/cgi\/viewcontent.cgi?article=1665&amp;context=gradschool_disstheses\">jumped from .3% to 5% of the population<\/a>, killing approximately <a href=\"https:\/\/www2.census.gov\/library\/publications\/decennial\/1850\/1850a\/1850a-15.pdf#\">13 percent<\/a> over the next <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC1750233\/pdf\/bullnyacadmed00243-0099.pdf\">four years<\/a>. Only when the epidemic overwhelmed the city did officials admit the full extent of yellow fever. Even in the face of it, some criticized the press for telling the truth and harming local businesses.<\/p>\n\n\n\n<p>The routine quarantines imposed on New Orleans dropped the anchor on shipping via the Mississippi or Gulf of Mexico, leaving the South dependent on railroads to transport cargo and passengers. Even relief supplies were blockaded and dismissed, since many <a href=\"https:\/\/deepblue.lib.umich.edu\/bitstream\/handle\/2027.42\/133400\/emiwap_1.pdf?sequence=1\" target=\"_blank\" rel=\"noreferrer noopener\">many believed<\/a> infection was passed not by interpersonal connection, but by contaminated air lingering in cargo.<\/p>\n<\/div>\n<\/div>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1430\" height=\"450\" src=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/yellow-fever.jpg\" alt=\"\" class=\"wp-image-389\" srcset=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/yellow-fever.jpg 1430w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/yellow-fever-540x170.jpg 540w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/yellow-fever-768x242.jpg 768w\" sizes=\"(max-width: 1430px) 100vw, 1430px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-trying-to-stop-a-moving-train\">Trying To Stop A Moving Train<\/h2>\n\n\n\n<p>Shotgun quarantines were highly effective, and neither train workers nor passengers had the stomach for a gun battle with local \u201csentinels\u201d, or their frequent threats of tearing up tracks and burning down bridges. Blockading river and train travel wreaked havoc on commerce and travel, and many large and small businesses went forced to shutter their doors permanently.<\/p>\n\n\n\n<p>Merchants and trade groups <a href=\"https:\/\/scholarship.law.upenn.edu\/cgi\/viewcontent.cgi?article=1615&amp;context=jcl\" target=\"_blank\" rel=\"noreferrer noopener\">lobbied states and Congress<\/a> to draft legislation authorizing state police power to break shotgun quarantines and administer commerce and efforts to isolate and prevent the spread of infection. Some state officials decried the notion, but many states\u2019 rights advocates found themselves <a href=\"https:\/\/scholarship.law.upenn.edu\/cgi\/viewcontent.cgi?article=1615&amp;context=jcl\" target=\"_blank\">long confirmed<\/a> a state\u2019s right to quarantine in the face of a real health emergency, including preventing access from people and cargo from outside the state.<\/p>\n\n\n\n<p>In the midst of a particularly devastating Yellow Fever outbreak, <a href=\"https:\/\/scholar.google.com\/scholar_case?case=12825058616387728191&amp;q=Louisiana+v.+Texas+::+176+U.S.+1+(1900)&amp;hl=en&amp;as_sdt=2006\" target=\"_blank\" rel=\"noreferrer noopener\">Louisiana asked the Federal government to break Texas\u2019 blanket quarantine<\/a> of people or cargo from Louisiana. The Pelican state insisted that the Lonestar state was only seeking to take out Galveston\u2019s commercial rival. The Supreme Court denied jurisdiction. Perhaps more importantly, a locality\u2019s right to impose a quarantine over Federal objection has never really been tested in court, and the extent of such a right <a href=\"https:\/\/scholarship.law.upenn.edu\/cgi\/viewcontent.cgi?article=1615&amp;context=jcl\" target=\"_blank\" rel=\"noreferrer noopener\">remains an open question today<\/a>.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:20%\">\n<h2 class=\"wp-block-heading\" id=\"h-local-quarantines-and-the-covid-19-coronavirus\">Local Quarantines and the Covid-19 Coronavirus<\/h2>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h3 class=\"wp-block-heading\" id=\"h-could-a-mayor-or-town-council-use-the-sheriff-and-available-deputies-to-prevent-entirely-in-state-operations-to-prevent-common-carriers-or-outsiders-from-entering\">Could a mayor or town council use the sheriff and available deputies to prevent entirely in-state operations to prevent common carriers or outsiders from entering?<\/h3>\n\n\n\n<p>The notion sounds less preposterous as states across the country have imposed <a href=\"https:\/\/www.cnn.com\/2020\/03\/31\/us\/states-travel-restrictions-list\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">air travel restrictions<\/a> targeting regions like New York and New Orleans, where Covid-19 cases <a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/cases-updates\/cases-in-us.html\" target=\"_blank\" rel=\"noreferrer noopener\">have been higher<\/a>.<\/p>\n\n\n\n<p><a rel=\"noreferrer noopener\" href=\"https:\/\/www.cnn.com\/2020\/03\/31\/us\/states-travel-restrictions-list\/index.html\" target=\"_blank\">Many officials<\/a> ordering such quarantines have deferred complete oversight, imposing only self-monitored quarantines. But as fatalities and knowledge about the virus has <a rel=\"noreferrer noopener\" href=\"https:\/\/voxeu.org\/article\/it-s-not-exponential-economist-s-view-epidemiological-curve\" target=\"_blank\">continued to grow<\/a>, some states <a rel=\"noreferrer noopener\" href=\"https:\/\/gov.georgia.gov\/press-releases\/2020-04-02\/governor-kemp-issues-shelter-place-order\" target=\"_blank\">have reversed their originally less stringent response<\/a> to the Covid-19 coronavirus. Federal travel restrictions imposed as a response to Covid-19 already eclipse any seen in the past several decades, and at present there is no clear end in sight to either the pandemic or the measures that may be necessary to arrest its advance.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-travel-in-the-era-of-the-covid-19-coronavirus\">Travel in the Era of the Covid-19 Coronavirus<\/h2>\n\n\n\n<p>During the Yellow Fever epidemics of the 19th century, many State Boards of Health even tried issuing <a href=\"https:\/\/scholarship.law.upenn.edu\/cgi\/viewcontent.cgi?article=1615&amp;context=jcl\" target=\"_blank\" rel=\"noreferrer noopener\">identity cards<\/a> confirming peoples\u2019 immunity if they had contracted and recovered from the disease in the past. In some cases the cards were honored, and <a href=\"https:\/\/scholarship.law.upenn.edu\/cgi\/viewcontent.cgi?article=1615&amp;context=jcl\" target=\"_blank\" rel=\"noreferrer noopener\">individuals were permitted<\/a> to travel on foot or by train through areas blockaded by shotgun quarantines.<\/p>\n\n\n\n<p>Modern travel involves an array of authentication features, including paperless boarding passes, facial recognition and <a rel=\"noreferrer noopener\" href=\"http:\/\/dhs.gov\/real-id\" target=\"_blank\">Real ID<\/a>, limitations like the <a rel=\"noreferrer noopener\" href=\"https:\/\/www.tsa.gov\/travel\/passenger-support\/travel-redress-program\" target=\"_blank\">No-Fly List<\/a> and individual <a href=\"https:\/\/www.treasury.gov\/resource-center\/sanctions\/programs\/pages\/programs.aspx\">travel sanctions<\/a>, and fast lanes like <a rel=\"noreferrer noopener\" href=\"https:\/\/www.tsa.gov\/precheck\" target=\"_blank\">TSA Pre-Check<\/a>. It is not out of the question to imagine a state developing technology and regulations to flag and monitor a traveler\u2019s health background.<\/p>\n\n\n\n<p>As to Covid-19 specifically, many epidemiological questions surround the virus, and both a <a href=\"https:\/\/www.sciencemag.org\/news\/2020\/03\/who-launches-global-megatrial-four-most-promising-coronavirus-treatments\" target=\"_blank\" rel=\"noreferrer noopener\">cure<\/a> and <a href=\"https:\/\/www.raps.org\/news-and-articles\/news-articles\/2020\/3\/covid-19-vaccine-tracker\" target=\"_blank\" rel=\"noreferrer noopener\">vaccine<\/a> seem distant. Research is <a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/about\/testing.html\" target=\"_blank\" rel=\"noreferrer noopener\">already underway<\/a> to develop an antibodies test that might reliably indicate if an individual had detected Covid-19 or developed an immunity.<\/p>\n\n\n\n<p>In the case of Yellow Fever, scientific advances <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC2892770\/\" target=\"_blank\" rel=\"noreferrer noopener\">eventually<\/a> led to a workable vaccine, but there still is <a href=\"https:\/\/www.cdc.gov\/yellowfever\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">no cure<\/a> for those infected, and even today, anyone traveling to countries that are still besieged by yellow fever generally must offer <a href=\"https:\/\/www.who.int\/ith\/ith_country_list.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">proof of vaccination<\/a>.<\/p>\n\n\n\n<p>With the CDC announcing that <a href=\"https:\/\/www.newsweek.com\/cdc-director-coronavirus-wave-late-fall-substantial-portion-americans-will-susceptible-1495401\" target=\"_blank\" rel=\"noreferrer noopener\">a second wave of the Covid-19 coronavirus is likely to hit in the Fall of 2020<\/a>, might the United States require proof of vaccination or immunity for air travelers in the age of Covid-19? And if such a regime were instituted, might state and even local authorities use it to enforce their own quarantines?<\/p>\n<\/div>\n<\/div>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1430\" height=\"450\" src=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/coronavirus-covid19.jpg\" alt=\"\" class=\"wp-image-398\" srcset=\"https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/coronavirus-covid19.jpg 1430w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/coronavirus-covid19-540x170.jpg 540w, https:\/\/www.justinian.com\/wp-content\/uploads\/2020\/10\/coronavirus-covid19-768x242.jpg 768w\" sizes=\"(max-width: 1430px) 100vw, 1430px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-local-quarantines-and-the-law\">Local Quarantines and the Law<\/h2>\n\n\n\n<p><a href=\"https:\/\/en.wikipedia.org\/wiki\/United_States_v._Guest\" target=\"_blank\" rel=\"noreferrer noopener\">Private actors<\/a> have been held legally liable for obstructing an individual\u2019s right to interstate travel, but what about official action by deputies or other local authorities? The Federal government can <a href=\"https:\/\/www.cdc.gov\/quarantine\/aboutlawsregulationsquarantineisolation.html\" target=\"_blank\" rel=\"noreferrer noopener\">accept or offer assistance<\/a> for states imposing quarantine and isolation methods, but its police power may be limited to state border crossings. Whether or not it can stop states from imposing quarantines remains <a href=\"https:\/\/scholarship.law.upenn.edu\/cgi\/viewcontent.cgi?article=1615&amp;context=jcl\" target=\"_blank\" rel=\"noreferrer noopener\">unclear<\/a>.<\/p>\n\n\n\n<p>Whatever the legal limits of Federal power, breaking a regional quarantine that has been duly-authorized under local law may be commercially and politically risky, as authorities discovered in the era of Yellow Fever learned all too well.
